Eligibility And Requirements
- Patent application in Form-1
- Provisional specifications, if complete specifications are not available
- Complete specification filled in Form-2 within 12 months of filing of provisional specification
- The inventor should show proof that he has right to file the patent application
- Declaration as to inventorship in Form 5 for applications with complete specification, convention application, or PCT application
- Statement and undertaking under Section 8 in Form- 3, if applicable
- A self-attested copy of power of attorney in case the patent is filed by a patent agent
- If the Patent Application is related to any biological material obtained from India, then the applicant is required to submit the permission obtained from the National Biodiversity Authority any time before the grant of the patent
